Congressman Mike Ezell, along with House Majority Leader Steve Scalise and Senator Ted Cruz, has filed an amicus brief in the case of Donald J. Trump v. Norma Anderson, et al. The brief has also gained support from 135 other House Republicans and 41 other Senate Republicans. The case revolves around whether former President Donald Trump should be allowed to remain on the ballot in the State of Colorado, after the Colorado Supreme Court ruled for his removal.

In this amicus brief, the Republican lawmakers argue that the decision made by the Colorado Supreme Court is an overreach that undermines the ability of voters to elect their leaders. Congressman Ezell expressed his support for the brief, stating, "The Colorado Supreme Court's decision to remove President Trump from the ballot is a massive overreach and a dangerous attack on voters' ability to elect their leaders. I'm proud to join my fellow legislators on this brief to defend the Constitution and our American democracy."

The Republican lawmakers point out that the Colorado Supreme Court's opinion disregards the prerogatives of members of Congress. They argue that the court has ignored numerous textual and structural limitations that are in place to ensure that Congress has control over the enforcement and removal of a president from office. Furthermore, they highlight the court's adoption of a broad interpretation of the term "engage in insurrection," which they believe could lead to widespread abuse against political opponents.

The amicus brief calls on the U.S. Supreme Court to overturn the ruling and allow President Trump's name to appear on the ballot in Colorado. The Supreme Court is scheduled to hear oral arguments in this case on February 8, 2024.

The filing of this amicus brief by Congressman Ezell and other Republicans demonstrates their commitment to defending the rights of voters and upholding the Constitution. It showcases their belief that the Colorado Supreme Court's decision poses a threat to the democratic process and sets a dangerous precedent. The outcome of this case will have significant implications for future elections and the balance of power between the judiciary and Congress.
